These Terms and Conditions ("Terms") are a legal agreement between you and MyNinjaSite.com, part of the NinjaSite.ai platform ("MyNinjaSite," "we," "us," or "our"), governing your use of our websites, the members area, and the websites and services we provide (the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old and able to form a binding contract. If you use the Services for a business, you represent that you are authorized to act for that business.
We build and host websites for local businesses and offer optional additional services. Sites are created with the help of automated and AI-assisted tools using publicly available business information. Features, availability, and any fees may change at any time.
We may build a free preview website for a business using publicly available information before the business signs up. A preview site does not imply affiliation with or endorsement by the business. If you own the business, you may claim and activate the site, or ask us to remove it by emailing support@myninjasite.com.
To manage a website you must set up an account with accurate information and a password. You are responsible for keeping your credentials confidential and for all activity under your account, and for notifying us of any unauthorized use.
By using the Services you agree we may contact you by email, phone, mail, and, where permitted, text message, for service and marketing purposes. You may opt out of marketing at any time (reply STOP to texts, unsubscribe from emails, or contact us). Essential messages about an active account cannot be opted out of. See our Privacy Policy.
Some features are offered free and others are paid. Paid plans may renew automatically until you cancel, and one-time services are charged when ordered. Except where required by law, fees are non-refundable, and you are responsible for any applicable taxes. If a payment is reversed or charged back, we may suspend or end the related Services.
You keep ownership of the content you provide or add to your website. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content to operate and promote the Services. You represent that you have the rights to all content you provide and that it does not infringe others' rights or break any law. We may feature websites we build in our portfolio and marketing.
The platform, software, templates, designs, and site code are owned by MyNinjaSite and its licensors. While your account is active we grant you a limited, non-exclusive, non-transferable license to use them for your own business website. You may not copy, resell, or reverse-engineer the platform, or use it to build a competing service.
You agree not to use the Services to break any law; infringe intellectual property or privacy rights; post malware, spam, or deceptive, hateful, or unlawful content; impersonate others; scrape or overload the Services; or interfere with their security or operation. We may remove content or suspend accounts that violate these Terms.
The Services may integrate with or link to third-party products. We are not responsible for third-party services, and your use of them is governed by their own terms.
Websites and content are produced with automated and AI-assisted tools and may contain errors. Content is provided "as is," and you are responsible for reviewing and correcting your website before relying on it.
The Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and without any warranty that the Services will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, MyNinjaSite and its affiliates and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. In every case, and no matter the cause or the form of action, our total combined liability to you for any and all claims of any kind relating to the Services will never exceed one hundred US dollars (US $100).
You agree to defend, indemnify, and hold harmless MyNinjaSite and its affiliates and personnel from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or of any law or third-party right.
We respect intellectual property rights. If you believe content on the Services infringes your copyright, email support@myninjasite.com (Attn: Copyright Agent) with details of the work and its location, your contact information, and a good-faith statement. We remove infringing material and may terminate repeat infringers.
You may stop using the Services at any time. We may suspend or terminate access, or remove a site, if you violate these Terms, fail to pay, or misuse the Services, and we may change or discontinue features. Sections that by their nature should survive termination will continue to apply.
Please read this section carefully; it affects your legal rights. If any dispute arises, you agree to first contact us and work with us in good faith to resolve it. If that does not settle the matter, you agree that the dispute must be submitted to confidential, good-faith mediation, and that mediation must be completed before you may file any lawsuit or other legal proceeding. You further agree that every dispute will be handled only on an individual basis, and that by accepting these Terms you agree not to start, join, or be a party to any class, collective, or representative action against MyNinjaSite, and you waive any right to participate in one.
MyNinjaSite is incorporated in the State of Wyoming, and these Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Subject to the mediation requirement above, the state and federal courts located in Wyoming will have exclusive jurisdiction over any dispute.
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Your continued use of the Services after an update means you accept the revised Terms.
